Description
Larry Oliver Schultz appeals from his conviction and sentence for armed bank robbery in violation of 18 U.S.C.A. § 2113(a), (d) (West 1991 & Supp. 1993) and aiding and abetting the use of a firearm during and in relation to a crime of violence in violation 18 U.S.C.A. § 924(c)(1) (West Supp. 1993). Schultz argues that the district court abused its discretion in denying his motions to suppress and for a continuance. Schultz also alleges that the district court erred in failing, based on its belief that it did not have the appropriate authority, to grant a downward departure and in sentencing him to the mandatory consecutive twenty-year sentence when the firearms convictions were contained in a single indictment. Finding no error, we affirm Schultzs conviction and sentence.
