Saul Serna-Villarreal, a previously deported Mexican citizen, was convicted of being found in the United States after having re entered without the permission of the Attorney General in violation of 8 U.S.C. § 1326. This appeal presents issues relating to the governments overlooking Sernas presence in state jails, his reindictment, and dates as to when he was "found" in the United States. Serna contends that (1) the district court erred in denying his motion to dismiss the indictment on speedy trial grounds; and (2) the evidence offered at trial was insufficient to support his conviction. We disagree with both contentions and therefore AFFIRM Sernas conviction.
