Description
FAY, Circuit Judge Defendant-appellant, Emil K. Schandl, was convicted of four counts of tax evasion in violation of 26 U.S.C. § 7201 and one count of failure to file a tax return in violation of 26 U.S.C. § 7203. On appeal, Schandl seeks reversal of his conviction on the grounds that the district court wrongly denied two motions: (1) a motion to suppress evidence seized at Schandl's home and office; and (2) a motion requesting early release of jury panel information needed to access certain tax background information of potential jurors under 26 U.S.C. § 6103(h)(5). We find no error with regard to the district court's ruling on Schandl's motion to suppress. Furthermore, although we find that the district court failed to comply with 26 U.S.C. § 6103(h)(5) by denying Schandl's motion for early access to jury panel information, this failure did not prejudice Schandl. We, therefore, AFFIRM. BACKGROUND
